How To Apply For Work Permit When You Enter Canada

Many international citizens require a work permit to get employed in Canada. The work permit is made up of two types, and these include the employer-specific work permit and the open work permit.

The Employer specific work permit allows you to get employed in Canada based on the requirements of your work permit, which includes;

  • The name of the particular employer you can get employed for
  • The duration you can be employed for
  • The place where you can get employed if relevant.

Before making an application for an employer-specific work permit, your employer is required to provide you;

  • A duplicate of your employment agreement
  • A duplicate of a LMIA, or
  • An offer of job code (for LMIA-exclude employees). To acquire this code, your employer is required to make use of the Employer Portal.

If your employer does not require you to use the Employer Portal to present a job offer letter, they must provide a copy of the job agreement.

The open work permit allows you to get employed by any employer in Canada, unless for an employer that;

  • Is mentioned as unqualified on the list of employers who fail to observe the conditions and rules or
  • Often provides striptease, escort services, erotic dance, or messages. You can only acquire an open work permit under certain conditions.

Some employees need a medical test. If you do not require medical requirements on your open work permit, you can receive a medical test from a panel doctor.

Qualification Conditions If You Apply When You Enter Canada At A Port Of Entry

You are required to make an application for your work permit before you start your journey to Canada. Hence, you can apply for a work permit when you arrive in Canada if you are qualified. To make an application at a Port of Entry (POE), you are required to satisfy all of the following:

  • Be eligible for an electronic travel authorization (eTA) or a trip without a visitor visa.
  • Satisfy other conditions based on the kind of work permit you are applying for.

Candidates For Employer-specific Work Permit

Your employer must have concluded all needed phases for your employer-specific work permit.

Seasonal Agricultural Worker Scheme

If you work in the Seasonal Agricultural Worker Program, you must be qualified to apply for a work permit at a Port of Entry.

Biometrics

Many candidates are not qualified to provide their biometrics at a Port of Entry. To provide your biometrics, you are required to satisfy two conditions:

  • Begin and conclude your application at the same Port of Entry
  • Be qualified to apply for a work permit at a Port of Entry.

Qualified candidates can provide their biometrics at the Port of Entry.

Qualification Conditions If You Make An Application From Inside Canada

You can only make an application from inside Canada if:

  • You possess an authentic study or work permit.
  • Your partner, spouse, or parents possess an authentic study or work permit.
  • You are qualified for a post-graduation work permit, and your study permit is still accurate.
  • You possess an authentic temporary resident permit for six months or more.
  • You are awaiting a judgment on a request for permanent residence from inside Canada.
  • You claimed refugee safety.
  • You have been identified as a convention refugee or safeguarded by the Immigration and Refugee Board of Canada.
  • You can get employed in Canada without a work permit but require a work permit to get employed in a distinct job.
  • You are an investor, trader, skilled, or intra-company transferee under the Canada – United States – Mexico Agreement (CUSMA).
